By accessing or using WanderTheSphere ("the Service"), operated by JSBmarketing(The Netherlands), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

AI-generated content may contain errors, outdated information, or inaccuracies. This content does not constitute professional travel, legal, medical, or financial advice. You are solely responsible for verifying all information before acting upon it. WanderTheSphere accepts no liability for decisions made based on AI-generated content.

You may upload photos and text to the Service ("User Content"). By doing so, you grant JSBmarketing a non-exclusive, royalty-free licence to host, display, and store that content solely for the purpose of providing the Service to you.
You represent and warrant that you own or have the necessary rights to any content you upload, and that it does not infringe the intellectual property rights of any third party. JSBmarketing is not liable for User Content uploaded by users.
DMCA / Copyright: If you believe content on the Service infringes your copyright, please contact our designated DMCA agent at info@wanderthesphere.com. We will review and act on valid notices in accordance with the Digital Millennium Copyright Act. Repeat infringers will have their accounts terminated.
WanderTheSphere offers free and paid subscription plans. Paid plans are billed in advance on a monthly or annual basis. All payments are processed securely via the App Store. Prices are listed in euros (EUR) and include applicable VAT where required by Dutch law.
Refund Policy: You may cancel your subscription at any time. Cancellations take effect at the end of the current billing period. We do not offer refunds for partial periods, except where required by applicable law (including Dutch consumer law, which may provide a 14-day cooling-off period for digital services).
You may delete your account at any time from your Profile settings. Upon deletion, your personal data will be permanently removed within 30 days. JSBmarketing reserves the right to suspend or terminate accounts that violate these Terms, including accounts engaged in abuse or fraudulent activity.
To the maximum extent permitted by Dutch and EU law, JSBmarketing shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to travel disruptions, errors in AI-generated itineraries, or hotel booking issues. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.
Binding Arbitration: Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or invalidity thereof, shall be settled by arbitration in accordance with the Arbitration Rules of the Netherlands Arbitration Institute (NAI). The arbitral tribunal shall consist of one arbitrator. The place of arbitration shall be Amsterdam, The Netherlands. The language of the arbitration shall be English or Dutch. The arbitral award shall be final and binding upon both parties.
Exception: Either party may seek urgent injunctive or other equitable relief from a court of competent jurisdiction to prevent irreparable harm. Nothing in this clause limits your rights as a consumer under mandatory Dutch or EU consumer protection law.
These Terms are governed by the laws of The Netherlands, without regard to conflict-of-law principles. If the arbitration clause does not apply to a particular dispute, you agree to the exclusive jurisdiction of the courts of Amsterdam, The Netherlands.
You agree to indemnify and hold harmless JSBmarketing, its officers, directors, employees, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the Service, your violation of these Terms, or your infringement of any third-party rights. JSBmarketing reserves the right to assume the exclusive defence of any matter for which you are required to indemnify us, and you agree to cooperate with our defence of such claims.
We may update these Terms from time to time. We will notify you of material changes via email or an in-app notice at least 14 days before they take effect. Continued use of the Service after the effective date constitutes your acceptance of the updated Terms.
